The New York code commissioners pro posed definitions of the two words which should treat them as distinct offences: larceny, to mean the taking of personal property, accomplished by fraud or stealth, or without color of right there to, and with intent to deprive another thereof; and robbery, to mean the wrongful taking of personal property in the possession of another from his per son or immediate presence and against his will, accomplished by means of force or fear.
